Terms of Service for Superhuman Go Agents

1. Acceptance of Terms

By installing, accessing, or using any of our Superhuman Go agents (the "Agents"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Agents.

Important: These Terms are in addition to, not in place of, Superhuman Go's Terms of Service and any terms of service for third-party services you connect through our Agents.

2. Description of Service

2.1 Agent Functionality

Our Agents are third-party integrations that enable Superhuman Go's AI platform to communicate with external services including, but not limited to:

  • Linear
  • Airtable
  • Mermaid
  • QuickBooks
  • Stripe
  • Toggl Track

2.2 Service Scope

Each Agent:

  • Connects to a single, specific third-party service
  • Acts as a communication bridge between Superhuman Go and that service
  • Processes requests in real-time without storing data
  • Requires appropriate authentication with the third-party service

3. User Requirements and Responsibilities

3.1 Eligibility

  • You must have a valid Superhuman Go account
  • You must be at least 13 years old (or the minimum age in your jurisdiction)
  • You must have appropriate access rights to any third-party services you connect

3.2 Account Requirements

  • You are responsible for maintaining valid accounts with relevant third-party services
  • You must ensure your third-party service accounts remain in good standing
  • You are responsible for managing authentication and permissions for connected services

3.3 Acceptable Use

You agree to use our Agents only for lawful purposes and in accordance with:

  • These Terms
  • Superhuman Go's Terms of Service
  • All applicable third-party service terms
  • All applicable laws and regulations

3.4 Prohibited Activities

You may not:

  • Use Agents to violate any third-party service's terms of use
  • Attempt to reverse engineer, modify, or create derivative works of our Agents
  • Use Agents to transmit malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to any systems or data
  • Use Agents in ways that could damage, disable, or impair any service

4. Intellectual Property

4.1 Agent Ownership

  • We retain all rights, title, and interest in our Agents
  • Our Agents are licensed, not sold, to you
  • You receive a limited, non-exclusive, non-transferable license to use our Agents

4.2 Third-Party Rights

  • Superhuman Go retains all rights to their platform and services
  • Third-party services retain all rights to their respective platforms and data
  • All trademarks and service marks remain the property of their respective owners

5. Privacy and Data Handling

5.1 No Data Storage

  • We do not store, collect, or retain any user data
  • All data processing occurs in real-time during active sessions
  • We do not have access to your authentication credentials

5.2 Data Flow

  • Data flows directly between Superhuman Go and third-party services through our Agents
  • We act only as a technical facilitator
  • Refer to our Privacy Policy for detailed information

6. Service Availability and Limitations

6.1 Service Availability

  • We strive to maintain reliable service but cannot guarantee 100% uptime
  • Service availability depends on both Superhuman Go's platform and third-party service availability
  • We may suspend or discontinue Agents at any time with or without notice

6.2 Third-Party Dependencies

  • Our Agents depend on third-party APIs and services
  • We are not responsible for third-party service outages, changes, or discontinuation
  • API rate limits imposed by third-party services may affect Agent functionality

6.3 Beta and Developmental Features

  • Some Agents or features may be provided as beta or pre-release versions
  • Beta features are provided "as is" without warranties
  • We may modify or discontinue beta features at any time

7. Disclaimers and Warranties

7.1 "AS IS" Provision

OUR AGENTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 No Warranty

WE DO NOT WARRANT THAT:

  • Our Agents will meet your specific requirements
  • Agent operation will be uninterrupted or error-free
  • Defects will be corrected
  • The Agents are free of viruses or harmful components

7.3 Third-Party Services

WE MAKE NO WARRANTIES REGARDING THIRD-PARTY SERVICES AND ARE NOT RESPONSIBLE FOR THEIR AVAILABILITY, FUNCTIONALITY, OR CONTENT.

8. Limitation of Liability

8.1 Liability Limits

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES.

8.2 Maximum Liability

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO OUR AGENTS SHALL NOT EXCEED $100 USD OR THE AMOUNT YOU PAID FOR PREMIUM FEATURES (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.

8.3 Third-Party Actions

WE ARE NOT LIABLE FOR ANY ACTIONS, OMISSIONS, OR CONTENT OF THIRD-PARTY SERVICES ACCESSED THROUGH OUR AGENTS.

9. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, and our respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of our Agents
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your use of connected third-party services

10. Termination

10.1 Termination by You

  • You may stop using our Agents at any time by uninstalling them from Superhuman Go
  • No refunds will be provided for any unused portions of paid services (if applicable)

10.2 Termination by Us

We may suspend or terminate your access to our Agents:

  • For violation of these Terms
  • If required by law or third-party service requirements
  • At our sole discretion with or without cause

10.3 Effect of Termination

Upon termination:

  • Your license to use our Agents immediately ends
  • All provisions that should survive termination will remain in effect

11. Governing Law and Disputes

11.1 Governing Law

These Terms are governed by the laws of Argentina without regard to conflict of law principles.

11.2 Dispute Resolution

  • Any disputes will be resolved through binding arbitration in Argentina
  • You waive any right to participate in class action lawsuits
  • Small claims court proceedings are permitted for individual claims under applicable monetary limits

12. General Provisions

12.1 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

12.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding our Agents.

12.3 Modifications

We may modify these Terms at any time by posting updated Terms. Continued use of our Agents after changes constitutes acceptance of the new Terms.

12.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

12.5 Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision.
